JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but later on, he has been remanded in the present case. The learned Additional Sessions Judge 6th has referred paragraphs-1, 9, 29, 33 and 37 of the case diary to show the involvement of the petitioner in the present case but he failed to mention the facts what have come in the aforesaid paragraphs of the case diary against the petitioner.

Learned counsel appearing for the petitioner submits that the name of petitioner came in confessional statement of coaccused Akhilesh Kumar and except the aforesaid confessional statement as well as some criminal antecedent, there is nothing

Patna High Court Cr.Misc. No.2073 of 2016 (2) dt.22-01-2016 2/2 against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S.Case No. 196 of 2013, G.R.
