Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 409, 467, 468, 471, 120(B)/34 of the Indian Penal Code.

The prosecution case as per F.I.R is that in a

Patna High Court CR. MISC. No.14250 of 2021(3) dt.10-02-2022 2/3 joint enquiry made by the A.D.M, Siwan and District Public Grievance Cell Officer, it was found that this petitioner has left Mangla Kamla Homeopathic Medical College & Hospital in the year 2016-2017 but he has still continuing taking the benefits of Student Credit Card Scheme.

It is submitted by learned counsel for the petitioner that the allegation against the petitioner that he has left the college in the year 2016-17 is false and fabricated as the petitioner is a regular student of the college and presently studying in Part-II of BHMS course and he has appeared in the examination conducted by the University in July, 2019 and December, 2019. The admit card and marks-sheet has been brought on record as Annexure-A series.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on

Patna High Court CR. MISC. No.14250 of 2021(3) dt.10-02-2022 3/3 furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil P.S. Case No. 471 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
