ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, who is in custody in connection with Sessions Trial No.871A/2001, arising out of Pirbahore P.S. Case No.159 of 1998, has misused the privilege of bail earlier granted to him.

Learned counsel for the petitioner submits that due to inadvertence and misunderstanding between the lawyer and the petitioner, the petitioner could not attend the court and, therefore, bail bond executed earlier was cancelled by the court below and as a result thereof, he was taken back in custody. Learned counsel further submits that the petitioner works outside Bihar for his livelihood and there shall be no recurrence

Patna High Court Cr.Misc. No.3822 of 2016 (2) dt.09-02-2016 2/2 of his not attending the court and he shall appear in the court below on all dates and shall not abstain himself on two consecutive dates without there being any reasonable cause and without the liberty of the court.

Considering the aforementioned facts and circumstances and that the petitioner has given the aforementioned undertaking, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-XI, Patna, in connection with Sessions Trial No.871A/2001 arising out of Pirbahore P.S. Case No.159 of 1998.
