The petitioner is languishing in custody since 19.03.2014 in a case registered for the offences punishable under Sections 384, 386 of the Indian Penal Code, 27 of the Arms Act and 3(1) (x) of SC/ST (Prevention of Atrocities) Act. The accusation is of demanding extortion of Rs.Five lakhs.
It is submitted by learned counsel for the petitioner that even assuming the accusation no offence under Sections 384 and 386 of the IPC is made out.
Considering the nature of accusation and the fact that the investigation has already concluded, let the above
Patna High Court Cr.Misc. No.15982 of 2015 (02) dt.22-05-2015 2/2 named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st, Saharsa in connection with Sessions Trial No. 2342 of 2014 arising out of Salkhua P.S. Case No. 263 of 2013. Since the petitioner is accused in five other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of offence or defaults for two consecutive occasions.
