JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Motipur P.S.Case No. 308/2015 registered for offences punishable under sections 302/34 of the Indian Penal Code.

The accusation is of committing murder of Shri Lal Rai, brother of informant Kishori Rai by the petitioner and two others named in the F.I.R.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. there is no eye witnesses of the occurrence and only deceased was seen shot dead at his flour mill. It is further submitted that due to earlier dispute

Patna High Court Cr.Misc. No.2581 of 2016 (3) dt.18-03-2016 2/2 and grudge between the informant Shri Lal Rai and the petitionerco-accused Jagdish Rai. Only suspicion has been raised against the petitioner by the informant. Further submission is that the petitioner has no criminal antecedent and he is in custody since 10.11.2015.

Considering the facts and circumstances, the above named petitioner, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate (West), Muzaffarpur in connection of Motipur P.S. Case No. 308/2015.
