Earlier the prayer for bail of the petitioner was rejected by the then Co-ordinate Bench of this Court, vide order dated 1.5.2019 passed in Cr. Misc. No.24688 of 2019 with an observation to conclude the trial within a period of one year. Submission of the learned counsel for the petitioner is that in this case all the witnesses have been examined except the Doctor and the I.O and all of them including the informant and his wife turned hostile. There is nothing against the petitioner. He is in custody for almost about 23 months. Heard learned A.P.P.

Having heard both sides and considering the fact that witnesses have turned hostile, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-

Patna High Court CR. MISC. No.1166 of 2020(4) dt.20-03-2020 2/2 (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Addl. Sessions Judge, Danapur in connection with Maner P.S.Case No.44 of 2018 dated 7.2.2018 with condition that he will co-operate in disposal of the trial and appear as and when required, otherwise his bail bond shall be cancelled.

Accordingly, with the above observation, this application is allowed.
