1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Bausi P.S. Case No.92/2023 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 379, 353, 332, 333, 307, 342, 506 and 504 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and from bare perusal of the allegation as alleged in the F.I.R., it would manifest that no specific allegation is alleged against the petitioner except that he was also member of an unlawful assembly. It is further submitted that the informant in order to coerce Rahul Kumar Paswan into submission implicated the
Patna High Court CR. MISC. No.5163 of 2024(2) dt.26-02-2024 2/2 entire family members including the petitioner who is distantly related to Rahul Kumar.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-1st Class, Araria in connection with Bausi P.S. Case No.92/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) amit/- U T
