Petitioner seeks bail in a case registered under sections 302, 201/34 of the Indian Penal Code. The informant named seven persons. It is alleged that when the deceased was coming through a boat he heard the sound of firing. Thereafter he wanted to flee away and accordingly he jumped in river. His dead body was recovered and blood was oozing from his nose. The informant alleged that all the accused persons assaulted her husband and killed him. It is submitted that the informant is not the eye witness of the occurrence. The victim died on account of Asphyxia due to drowning. Other accused Pappy Yadav has already been enlarged on bail vide Cri. Misc. No. 32005 of 2013.

Patna High Court Cr.Misc. No.9672 of 2015 (3) dt.07-05-2015 2/2 Considering the aforesaid facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Additional Chief Judicial Magistrate, Naugachia in Ismailpur P.S. Case no. 16/12.
