JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but it appears that in course of investigation, the name of petitioner surfaced in the confessional statement of co-accused Chottu Ram @ Rajesh Ram and after that one motorcycle, which is said to have been used in committing the alleged crime, was recovered from the house of the petitioner. It appears that except the aforesaid material, there is nothing against the petitioner. Moreover, petitioner is in jail custody since 21.11.2015 but it appears that he has not been put on T.I.P as yet. Considering the aforesaid facts and circumstances as
