The petitioner is in custody since 16.12.2019 in connection with Excise Case No.766 of 2019 arising out of Durgawati P.S. Case No.285 of 2019 registered for the offence under Section 30(A) of Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner and neither he is owner of the seized vehicle or any connection with the illicit liquor.

Considering the aforementioned facts and circumstances and that the the alleged recoveries were not from

No.748 of 2020(2) dt.20-01-2020 2/2 the conscious possession of the petitioner, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-III-cum- Special Judge, Excise, Kaimur at Bhabua in connection with Excise Case No.766 of 2019 arising out of Durgawati P.S. Case No.285 of 2019.
