2. The petitioner seeks regular bail in connection with G.R.P. Bakhtiarpur (Khusharupur) P.S. Case No. 18 of 2023, registered under Sections 302, 201, 120(B), 34 of the Indian Penal Code and section 27 of the Arms Act.

3. The deceased was killed by the accused persons. The F.I.R. was registered against co-accused Mahendra Yadav @ Baba. The name of the petitioner has come up in the self inculpatory statement of co-accuse Mahendra Baba. Co-accused Mahendra Baba stated that he and the petitioner have shot at the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He furhter submits that only one injury has been found on the deceased and

Patna High Court CR. MISC. No.4564 of 2025(3) dt.19-04-2025 2/2 it appears that petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent and he is in custody since 08.08.2024.

5. Learned A.P.P. for the State has opposed the prayer for bail.

6. Considering the facts and circumstances of the case and also period of custody, this bail application is allowed.

7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned court of Railway Judicial Magistrate, Patna/concerned court below in connection with G.R.P. Bakhtiarpur (Khusharupur) P.S. Case No. 18 of 2023, subject to the condition that the petitioner shall cooperate in the trial and shall be represented through personally or through his lawyer. (i) The petitioner will mark his attendance at Khusrupur Police Station on every Sunday of each month. Any default in appearance at the local Police Station will result into cancellation of his bail bond.
