The petitioners are in custody since 07.12.2019 in connection with Excise Case No.899 of 2019, arising out of P.R. No.15 of 2019-20 registered for the offence under Section 30(A) of Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioners submits that the alleged recoveries were not from the conscious possession of the petitioners. They are neither owners nor the drivers of the alleged vehicle. It is stated that they are merely a passenger and have no criminal antecedent.

Considering the aforementioned facts and

No.742 of 2020(2) dt.20-01-2020 2/2 circumstances and that the petitioners have no criminal antecedent, let the petitioners, above named, be released on bail on their furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Kaimur at Bhabua, Excise Case No.899 of 2019, arising out of P.R.
