1. Heard learned counsel for the appellant and learned Spl.P.P. for the State.

2. Learned counsel for the appellant submits that the appellant is a person with clean antecedent and from perusal of the allegations as alleged in the FIR it would manifest that no specific allegation of assault is alleged against the appellant but then it is submitted that the police after investigation submitted charge-sheet based on which cognizance has been taken, as such the present appeal has become infructuous and thus the learned counsel for the appellant seeks permission to withdraw the same.

3. Permission is accorded.

4. However, in the event if the appellant surrenders on before 18.08.2023, the learned trial court shall dispose of the case on the same day keeping in mind the fact that there is no specific allegation of assault against the appellant.

5. Accordingly, the present application stands dismissed as withdrawn.
