The petitioner seeks his bail in Darbhanga Town P.S.Case No.04 of 2015 registered under Sections 399, 402, 412 of the Indian Penal Code and sections 25(1-b)A, 26 and 35 of the Arms Act.
The allegation against the petitioner is that he was apprehended and from his possession, a knife was recovered. It has been submitted on behalf of the petitioner that as per the FIR, one revolver and cartridge is said to have been recovered from the possession of co-accused Md. Wakil, and only one knife was recovered from the possession of the petitioner and for the same, the provisions of the Arms Act could not be attracted in the case of the petitioner. Further it is submitted that the petitioner is in custody since 6.1.2015.. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the facts aforesaid, the petitioner, named
Patna High Court Cr.Misc. No.16610 of 2015 (2) dt.11-06-2015 2/2 above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Town P.S.Case No.04 of 2015 (G.R.No.91 of 2015).
