The petitioners are languishing in custody since 06.01.2015 in a case registered for the offences punishable under Sections 147, 148, 149, 332, 333, 353, 307, 427, 504 of the Indian Penal Code and 3/4 of Prevention of Damage to Public Property Act.
It is alleged that when the police went to apprehend one Lalan Rai then the family members and others assaulted the police personnel and damaged the police vehicle. On the spot the petitioners were apprehended.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.10513 of 2015 (02) dt.23-03-2015 2/2 petitioners that the accusation is omnibus and general. The injuries of the police personnel are found absolutely superficial simple in nature.
A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Ishuapur P.S. Case No. 02 of 2015.
