Petitioner is in custody in connection with Durgawati P.S.Case No.46 of 2019 registered for the offences punishable under Section 304-B of the IPC.

Petitioner happens to be the husband of the deceased and the case is of dowry death.

Submission is that altogether six witnesses have been examined in this case including the informant and his family members and none of the witnesses have supported the prosecution case. They have denied the prosecution story. As such, there is absolutely nothing against the petitioner. He is in custody since 02.03.2019 and the case is pending only for the report of FSL.

In view of the submission as made above, let the above named petitioner be released on bail on furnishing bail bond of Rs/.25,000 (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Kaimur at Bhabua in connection with Sessions Trial No.113 of 2019 arising out of Durgawati P.S.Case No.46 of 2019 with condition that he will appear before the trial Court as and when required, otherwise, the bail bond of the petitioner shall be cancelled.
