The petitioner is languishing in custody since 03.04.2014 in a case registered for the offences punishable under Sections 399, 402 and 120B of the Indian Penal Code. It is alleged that on information that miscreants are preparing to commit dacoity, raid was laid when from the possession of the petitioner one pistol and one cartridge were recovered for which separate case was lodged under Arms Act in which petitioner has been granted bail, though, after registration of the present case the petitioner has been framed in other cases.
Patna High Court Cr.Misc. No.4455 of 2015 (02) dt.10-03-2015 2/2 It is submitted by counsel for the petitioner that similarly situated accused Golu Kumar has been granted bail vide Cr. Misc. No. 40190 of 2014.
Considering the nature of accusation and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah City P.S.
