The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 341, 323, 324, 326, 307 and 354 of the Indian Penal Code.

The prosecution case is that petitioner no.

1 Ghanshyam Ram caused injury to the informant with knife on

No.4844 of 2016 (2) dt.05-02-2016 2/3 the left ear, petitioner no. 2 Rajjan Ram assaulted the informant with rod on right hand whereas petitioner no. 3 Vinod Ram assaulted the informant with rod on left knee. It is alleged that co-accused Dasrath Ram made an attempt to put Acid in the eyes of the informant. It is further alleged that petitioner no. 1 and coaccused Suresh Ram made attempt to put the house on fire. It is submitted by learned counsel for the petitioners that since the informant side killed the son of coaccused Dasrath Ram for which earlier a case was lodged, hence, as a retaliatory measure the present case has been lodged, though, petitioner no. 1 is accused in six other cases but all of them have been lodged at the behest of the informant side. There is no injury found caused by knife as alleged against petitioner no. 1.

It is submitted by learned counsel for the informant that out of five injuries four have been found to be grievous and there is omnibus and general accusation of making assault.

Considering the aforesaid facts, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection

Patna High Court Cr.Misc. No.4844 of 2016 (2) dt.05-02-2016 3/3 with Korma P.S. Case No. 54 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Sheikhpura. With the aforesaid observation, this application is disposed of.
