====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-01-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Riga P.S. Case No.315 of 2019 registered under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving the secret information about selling of Nepali Liquor by Ramesh Ram (petitioner) and Bharat Ram in village-Riga Imli Bazar, the informant along with other police personnel reached there, where two persons were found standing near the sacks. On seeing the police party, both the persons started to flee away but, on chase, one was apprehended, while another succeeded to flee away taking the advantage of the darkness. On query, the

No.795 of 2020(2) dt.21-01-2020 2/2 apprehended person disclosed his name as Ramesh Ram (petitioner) and he also disclosed the name of the person, who succeeded to flee away, as Bharat Ram. On search of the four recovered sacs, 480 bottles, each containing 300 ml. Nepali liquor, were recovered.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case on mere suspicion. The petitioner having no criminal antecedent is in custody since 19.11.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi, in connection with Riga P.S. Case No.315 of 2019.
