JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-03-2022 Heard Mr. Anil Kumar Singh, learned Advocate for the petitioner and Mr. Umanath Mishra for the State. The petitioner seeks bail in anticipation of his arrest in connection with Hilsa P.S. Case No. 466 of 2020 dated 19.09.2020 instituted for the offences under Sections 341, 323, 504, 385, 307, 379 & 34 of the Indian Penal Code.

The petitioner along with others is said to have barged into the house of the Informant and on the Informant not paying up the protection money demanded from them, assaulted the informant and others.

So far as the petitioner is concerned, he is specifically alleged to have assaulted the informant in his stomach by means of the butt of the gun.

The learned counsel for the petitioner has submitted that the accusation is absolutely false and motivated. The injuries suffered by the informant/victim is only in

The mother of the petitioner has also filed a case against the informant and his mother, regarding the informant keeping a lustful eye on the sister of the petitioner, in which act the mother of the informant has also been supporting him.

The petitioner earlier has been made accused in three cases which have been listed in para-3 of the bail petition, in all of which, he has been granted bail.

Regard being had to the aforestated background facts and taking into account the nature of injuries suffered by the informant, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa (Nalanda) in connection with Hilsa P.S. Case No. 466 of 2020 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) rishi/- U T
