JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 15.04.2014 in a case registered for the offences punishable under Section 386 of the Indian Penal Code and Section 25(1-b) a, 26 of the Arms Act. No doubt, petitioner carries criminal antecedent of seven cases but so far as seized gun is concerned, it is submitted that the aforesaid gun is of relative of the petitioner who had come at his home on the alleged date of recovery and unfortunately, the police seized the aforesaid gun. To fortify the above stated contention, he drew my attention towards Annexure-3 to this petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.5679 of 2015 (2) dt.13-02-2015 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt.
