JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to the prosecution case itself, petitioner and F.I.R. named accused Saurav Kumar took the deceased from his home and after that co-accused Deepak Kumar Mahto and Raj Kumar Mahto gave dagger blows to the deceased. There is only allegation of conspiracy against the petitioner on the ground that prior to alleged occurrence, petitioner had fled away along with daughter of one Shiv Kumar and in the aforesaid incident, the deceased had played an important role.

Considering the aforesaid facts and circumstances and also taking note of the fact that petitioner does not have any criminal antecedent and the investigation against him has already

Patna High Court Cr.Misc. No.2813 of 2016 (2) dt.30-01-2016 2/2 been completed, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M.Ist Class (Sri Deepak Kumar), Barh, District Patna in connection with Bhadaur P.S. Case No.49 of 2015.
