Patna High Court MJC No.1946 of 2017 (3) dt.20-12-2017 Counsel to Additional Advocate General No.3 for the State. The writ petition filed by the petitioner was disposed of with a direction to the District Magistrate, Madhepura to take a final decision on the promotion of Group-D employees to Group-C post and dispose of the same in accordance with law within a period of six weeks from the date of receipt/production of a copy of the order. Although there was some delay in disposal of the matter of promotion and in the meantime the petitioner has superannuated on 31.3.

2017 but the final orders on the issue of promotion from GroupD employees to Group-C has been passed, a copy of which is present at Annexure 'G' to the show cause and which does not find any of the panelist fit for promotion to Group-C which obviously would include the petitioner although he has already superannuated. Be that as it may, if this order present at Annexure 'G' passed by the committee dated 11.12.2017 does not satisfy the petitioner he is at liberty to challenge the same before the appropriate forum by filing an appropriate application but no cause of contempt is made out.
