JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-04-2019 The petitioner apprehends his arrest in connection with Supaul P.S.Case No. 432 of 2018 registered under Sections 379 and 420 of the Indian penal Code.
Allegation as per FIR is that more than Rs. 2 lacs has been withdrawn from the account of the informant leaving only Rs. 512/- in his account and it further appears that out of that, Rs. 1,20,000/- has been deposited in the account of the petitioner.
Submission of learned counsel for the petitioner is that someone else has made withdrawal and deposited in the account of the petitioner and later on amount is withdrawn through ATM for which petitioner may not be held responsible. He further submits that petitioner has also informed the authority about deposit of amount in his account and he is a Government

Having heard both sides and in the facts and circumstances, as stated above, let petitioner surrender within a period of six weeks from the date of receipt of a copy of this order and on his surrender, he will be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Supaul in connection with Supaul P.S. Case No. 432 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that he has to co-operate in investigation and will appear before the I.O. as and when required and after investigation, if charge sheet is submitted against the petitioner, he has to surrender and make prayer for regular bail, which shall be considered and disposed of, without being prejudiced by this order, on the basis of material available on record at that time.
