According to the prosecution case itself, it were co-accused Anil Prasad Mahto and Raj Kumar Mahto who gave dagger blows to the deceased and so far as the petitioner is concerned, it is only stated that he along with two others took the deceased from his house. Moreover, having more or less similar allegation one coaccused Chandan Kumar has already been granted privilege of bail by this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, Judicial Magistrate, Ist Class, Barh District Patna/ concerned court in Bhadaur P.S. Case no. 49/2015.
