The petitioner is apprehending his arrest in connection with Motipur P.S. Case No. 454 of 2019 for the offence registered under Sections 272 and 273 of the Indian Penal Code and Section 30 (a), 41 (1) (2) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were made from a Public land near the Purani Bazar Mai Sthan and have nothing to do with the present petitioner. It is further submitted that one Shivnath Paswan, who was identified as one amongst certain persons who were seen fleeing away but the petitioner's name has come only on the basis of suspicion.

No.886 of 2020(2) dt.21-01-2020 2/2 Considering the fact that nothing has been recovered from his conscious possession and that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Muzuffarpur in connection with Motipur P.S.
