The petitioner filed this Writ Petition for quashing of Annexure-13 by which the engagement of the petitioner on the post of Shiksha Mitra was terminated on 06.12.2005. The petitioner was working on the post of Shiksha Mitra.
Patna High Court CWJC No.17607 of 2008 (6) dt.02-02-2017 2/2 Admittedly, the petitioner was not working on the post of Shiksha Mitra on 01.07.2006, the date on which the services of the persons working on the post of Shiksha Mitra were absorbed in the cadre of Panchayat Teacher / Prakhand Teacher. Learned counsel for the petitioner submits that although this is disputed that the petitioner was not working as Shiksha Mitra on 01.07.2006 but from the order of termination, it appears that the service of the petitioner from the post of Shiksha Mitra was terminated on 06.12.2005.
Learned counsel for the petitioner seeks permission to withdraw this Writ Petition with liberty to seek remedy before appropriate forum.
In view of the law laid down by a Full Bench of this Court in Kalpana Rani's case, reported in (2014) 2 PLJR 665, the dispute has already been set at rest. The petitioner is allowed to withdraw this Writ Petition.
Accordingly, this Writ Petition is dismissed as withdrawn with liberty to the petitioner to seek remedy at appropriate forum.
