JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 25.11.2014 in a case registered for the offences punishable under Sections 392 and 411 of the Indian Penal Code. It is alleged that the informant's ATM card was robbed by the miscreants when informant had to disclose PIN under the threat, subsequently, the accused persons withdrew Rs.20,000/- by using robbed ATM card of the informant. The petitioner was named in the FIR.

It is submitted by the learned counsel for the petitioner that there is no recovery from the petitioner. It is further submitted that the informant has retracted from the initial version and has filed a petition to that effect before the learned court below.

No.12105 of 2015 (2) dt.30-03-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Laheriasarai P.S. Case No. 544 of 2014.

Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on two consecutive occasions.
