2. The petitioner seeks regular bail in connection with Maner P.S. Case No. 298 of 2023 registered on 23.04.2023 under Sections 279, 323, 307, 341, 504, 506/34 of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against four named accused persons with allegation that they have assaulted the informant's nephew with lathi and danda due to which he was injured.

4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 20.09.2023 having no criminal case pending against him. Counsel submits that the present case has been

He further submits that from the content of the F.I.R. itself, it is very much clear that the informant and petitioner both belong to the same village and well known to each other and the alleged occurrence took place accidentally by his tractor. It is also very much clear from the F.I.R. that the occurrence is of 08.04.2023 whereas F.I.R. has been lodged on 23.04.2023 and such delay has not been explained.

5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Danapur, in connection with Maner P.S. Case No. 298 of 2023, subject the conditions laid down under Section 437 (3) of the Cr.P.C.
