JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 06-04-2018 This writ petition, in public interest, under Article 226 of the Constitution of India has been filed and the grievance in the writ petition is that after coming into force of the Bureau of Indian Standard Act, 2016, in accordance to the requirement of Section 38 of the Act for implementation of the enactment has not been framed and seeking a mandamus for commanding the Government of India to formulate the Rules after the Act came into force on 22nd March, 2016.
Today, during the course of hearing the learned Additional Solicitor General brings to our notice an extra
Patna High Court CWJC No.12603 of 2017(5) dt.06-04-2018 2/2 ordinary gazette notification of the Government of India published by the Ministry of Consumer Affairs, Food and Public Distribution on 18th October, 2017, wherein the Bureau of Indian Standard Act, 2016, has been formulated and its amendment came into force with effect from 18th October, 2017, after filing of this writ petition and the only grievance of the petitioner was that the Rules havek not been framed. The gazette notification produced before us goes to show that the exercise of the power conferred has now been framed. We wee no reason to keep the matter pending. If any of the provisions of the Rules is not in accordance with law, the petitioner shall have liberty to challenge the same. No further direction is needed to be issued.
The petition is disposed off with the aforesaid liberty to the petitioner.
