JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It appears that earlier the petitioner was on bail but his bail bonds was cancelled on 04.12.2006 and thereafter he was arrested and remanded on 28.11.2014 and since then he is languishing in jail custody in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code. Para-3 of this petition reveals that petitioner does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Saran at Chapra in connection with
Patna High Court Cr.Misc. No.6031 of 2015 (2) dt.13-02-2015 Dariyapur P.S. Case No. 151 of 2000 subject to condition that he shall attend the trial court on each and every date in person for the period of nine months or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
