JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date: 17-04-2018 Heard learned counsel for the petitioner and State. Learned counsel for the petitioner submits that the case of the petitioner is similar to the case of Ravi Pratap Singh (C.W.J.C. No. 8704 of 2017) and Ram Deo Singh (C.W.J.C. No. 7587 of 2017).

Since no counter has been filed on behalf of respondent nos.1 and 2 and in the absence the counter affidavit of respondent nos. 1 and 2, final adjudication as to the claim of the petitioner is not possible.

Since the counsel for the petitioner is claiming that the case of this petitioner is similar to the case of Ravi Pratap Singh

Patna High Court CWJC No.8727 of 2017 dt.17-04-2018 2/2 (C.W.J.C. No. 8704 of 2017) and Ram Deo Singh (C.W.J.C. No. 7587 of 2017) and the case of this petitioner was considered by the Director, Secondary Education vide Memo No. 198P dated 29.12.2017 along with Ravi Pratap Singh and Ram Deo Singh, instead of keeping the matter pending, it is disposed of with a direction to Director, Secondary Education, who shall examine the claim of the petitioner in the light of Memo No. 198P dated 29.12.2017 and extend similar benefit to this petitioner like the petitioner Ravi Pratap Singh of C.W.J.C. No. 8704 of 2017 and Ram Deo Singh of C.W.J.C. No. 7587 of 2017. final decision in this regard must be taken by the respondents within a period of 60 days from the date of receipt/production of a copy of this order and the consequential benefit may be extended to the petitioner within a further period of one month from such decision. With the aforesaid, the writ application stands disposed of.
