Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in Makhdumpur P.S. Case no. 21 of 2020 registered for the offence punishable under sections 304B and 120B of the Indian Penal Code. As per prosecution case, daughter of the informant was married with the petitioner in the year 2019 and thereafter petitioner and others subjected her to torture and harassment for demand of dowry. It is further alleged that on 13.01.2020 this petitioner informed the informant that victim was not in the house and when search was made and her dead body with knife injury was found near railway track.

It is submitted that petitioner has been falsely implicated in this case and at the time of occurrence, petitioner was at the house of

Patna High Court CR. MISC. No.15357 of 2021(2) dt.23-07-2021 2/2 the informant and victim/ deceased was at her Naiher and no altercation took place between the parties on fateful night. There was complete harmony between husband and deceased and she was pregnant of three months. He never demanded any dowry. There is no eye witness to the occurrence. He has been made accused only on suspicion. He is in custody since 15.01.2020. Investigation is complete.

Learned counsel for the informant vehemently opposed the prayer for bail and submitted that thrust of allegation is against this petitioner who is husband of deceased. There is allegation of demand of dowry and body was found near railway track. Taking into consideration serious nature of allegation and the circumstances in which the dead body was found and petitioner being husband against whom specific allegation of demand of dowry, bail application of the petitioner is rejected.
