The instant appeal has been filed by the appellant against the order dated 02.12.2025 passed by learned Additional Sessions Judge, 1st -cum-Special Judge, Kaimur at Bhabhua, whereby the prayer for bail application of the appellant in connection with Mohania P.S. Case No. 890 of 2025 registered for the offence under Sections 103(1), 3(5) of the BNS and under Section 3(1)(r)(s), 3(2)(v) of SC/ST (POA) Act, was rejected.

3. The appellant and others are said to have stabbed the deceased.

4. The appellant is in custody since 22.10.2025.

5. Learned counsel for the appellant has submitted that the appellant is only a member of the mob and it is one Aman Bari, who is the main accused in this case.

6. Learned Special P.P. for the State and informant have vehemently opposed the prayer for grant of bail to the appellant.

7. Considering the aforesaid facts, this application is allowed and accordingly, the order dated 02.12.2025 is hereby set aside.

8. Let the appellant be released on bail upon furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Mohania P.S. Case No. 890 of 2025.

9. So far as the informant is this case is concerned, he is also named in a case bearing Mohania P.S. Case No. 983 of 2025 registered for the offence under Sections 103(1) and other sections of BNS.

10. In the opinion of this, the informant may prefer and anticipatory bail application and is not required to surrender as per the direction of this Court vide order dated 2.4.2026. (Sandeep Kumar, J) Vikas/- U
