The petitioner is languishing in custody since 04.1.2.2014 in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code.
It is alleged that the informant's motorcycle was stolen from the bank premises. Subsequently the petitioner was arrested with stolen motorcycle leading to the registration of the case under Section 414 of the Indian Penal Code. It is submitted by learned counsel for the petitioner that the petitioner has been granted bail in subsequent case, hence he has been roped in the earlier case of theft also but nothing has surfaced that the petitioner committed theft of the
Patna High Court Cr.Misc. No.5550 of 2015 (02) dt.13-02-2015 2/2 alleged motorcycle and petitioner is not involved in any other case except the two cases lodged for the theft and recovery of the motorcycle of the informant.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Hisua P.S.
