The petitioner seeks bail in Sanjhauli P.S. Case No. 68 of 2021, registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, while the informant (vegetable seller) was going to purchase vegetable on tempo, on the way, 3-4 miscreants riding on two motorcycles stopped the tempo and on the point of pistol, snatched cash of Rs. 30,000/-, mobile from possession of informant and also snatched cash of Rs. 1500/- and gold locket from possession of tempo driver. Thereafter, all the miscreants fled away.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of this petitioner has come in this case on the basis of Spy after 18 days of

Patna High Court CR. MISC. No.2776 of 2022(2) dt.25-03-2022 2/2 occurrence. No incriminating article has been recovered from possession of this petitioner except cash of Rs. 1500/- which belongs to petitioner. The same is not stolen, as the same has not been put on test identification parade till date. Petitioner claims clean antecedent and he is in custody since 22.08.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Bikramganj Rohtas in connection with Sanjhauli P.S.
