JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, petitioner is named in the first information report as member of unlawful assembly but no specific overt-act has been attributed against him except this fact that he was abusing the deceased at the time of alleged occurrence. Petitioner is in jail custody since 24.11.2015 without having any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
