The petitioner seeks bail in connection with Bihta P.S. Case No. 267 of 2017 registered under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)A, 26/35 of Arms Act.

One loaded country made pistol is said to have been recovered from the possession of the petitioner who is said to have assembled at the place of occurrence along with other accused persons for committing some occurrence. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case at the instance of his enemy by planting the aforesaid

Patna High Court Cr.Misc. No.62233 of 2017(6) dt.14-03-2018 2/2 recovery from his possession. No incriminating article has been recovered from his conscious physical possession. He has no criminal antecedent. He has been languishing in custody since 25.04.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur in connection with Bihta P.S. Case no. 267 of 2017.
