====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-01-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners seek bail in connection with Dharhara P.S. Case No.105 of 2019/G.R. No.1149 of 2019 registered under Sections 304B, 120B and 201 of the Indian Penal Code. The accusation is that the marriage of the deceased, the sister of the informant, was performed before 7 years with Saudagar Yadav and due to wedlock, the sister of the informant was blessed with two children but the sister of the informant was being tortured by her husband and other in-laws due to nonfulfillment of the demand of dowry of cash Rs.2,00,000/-. In the evening of 02.05.2019, when the informant went at the
Patna High Court CR. MISC. No.793 of 2020(2) dt.21-01-2020 2/2 house of his sister, then he found the house locked. On query from the nearby people, the informant came to know that his sister has been killed and her dead body has been disposed of. Learned counsel appearing on behalf of the petitioners submits that the petitioners are the brother of the husband of the deceased, the sister of the informant. On mere suspicion, they have also been implicated in this case. More so, the husband of the deceased, the sister of the informant, is already in custody. The petitioners have no criminal antecedents. The petitioner no.1 is in custody since 04.09.2019 and the petitioner no.2 is in custody since 29.08.2019.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger, in connection with Dharhara P.S.
