JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Garkha P.S. Case No. 558 of 2019 registered for the offences punishable under Sections 307, 328 and 379/34 of the Indian Penal Code.
It is alleged that petitioner no. 1 threw white colour powder on the eye of informant as a result of which the informant became unconscious and after some time he re-gained his consciousness and he found himself lying near bank of river and his legs were tied with his own baniyan. Submission on behalf of the petitioners is that the informant happens to be relative of the petitioners and as a

No.5075 of 2020(2) dt.03-03-2020 2/2 matter of fact, the relation of petitioners with informant was strained at the time of alleged occurrence and moreover, no injury was found on the person of the informant which is evident from perusal of the impugned order itself. Considering the aforesaid facts and circumstances as well as submissions of the parties let above named, petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran, in Garkha P.S. Case No. 558 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
