JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Govt. Official PR Case No. 31 of 2021 (Spl. Case No. 7372 of 2021) instituted for the offences under Sections 30(a) and 32(3) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 13.11.2021, is a person with clean antecedent and prosecution report has been submitted in the case.

Learned counsel for the petitioner submits that the allegation is of recovery of 100 litres of liquor from a tempo. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.2667 of 2022(2) dt.04-03-2022 2/2 petitioner is the driver of the said tempo and as such was not knowing which passenger had kept the liquor in the tempo. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Govt. Official PR Case No. 31 of 2021 (Spl. Case No. 7372 of 2021).
