Petitioner apprehends arrest in a case registered for the offence punishable under sections 363, 366(A) of the Indian Penal Code.

The allegation against the petitioner is that he kidnapped informant's granddaughter while she had gone to coaching Institute.

Learned counsel for the petitioner submits that the girl in her statement recorded under section 164 of the Cr.P.C has not supported the prosecution case and stated that she voluntarily married with the petitioner. The Court below has also assessed her age to be 17 years.

Considering the 164 Cr.P.C. statement of the victim,

Patna High Court CR. MISC. No.5008 of 2023(2) dt.07-04-2023 2/2 in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Darbhanga, in A.P.M. (Pataur O.P.) P.S. case no.207 of 2020 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
