JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 14-06-2022 At the very outset, learned counsel for the petitioners, seeks permission to withdraw the petition of petitioner no.2, namely Shivdhari Chaudhary and petitioner no.7, namely, Shravan Kumar Yadav @ Shravan Kumar.

Permission is accorded.

Accordingly, the petition of petitioner no.2, namely, Shivdhari Chaudhary and petitioner no.7, namely, Shravan

Patna High Court CR. MISC. No.3536 of 2022(2) dt.14-06-2022 2/3 Kumar Yadav @ Shravan Kumar is dismissed as withdrawn. Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 337, 338, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is a case of assaulting to the informant and his family members by the accused persons including the petitioners.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that there is general and omnibus allegation against them and no one has sustained injury during assault and they have not inflicted injury to any one.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioners, namely, Sunita Devi @ Sunita Chaudhary, Ramlachhan Chaudhary, Shailendra Yadav @ Shailendra, Vinod Kumar @ Vinod Yadav and Dharmendra Yadav @ Dharmendra Chaudhary @ Durendra Yadav, in the event of their arrest or

No.3536 of 2022(2) dt.14-06-2022 3/3 surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-XV, Gopalganj in connection with Mirganj P.S. Case No. 248 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
