The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341/323/385/504/506/34 of the Indian Penal Code. Prosecution case is of collecting Rs.50/- to Rs.100/- as extortion from the public carrier vehicles. It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. From the impugned order, it appears that the investigation has concluded and the charge-sheet has been submitted against the petitioners under sections 341, 323, 385, 504, 506, 34, of
Patna High Court Cr.Misc. No.3683 of 2016 (3) dt.05-02-2016 2/2 the Indian Penal Code.
Considering the fact that petitioners have been charge-sheeted, let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Maheshkhunt P.S. Case No.112/2014, pending before the learned CJM, Khagaria.
With the above observation, this application is, accordingly, disposed off.
