The petitioners are apprehending arrest in connection with Bisphi P.S. Case No. 140 of 2016 (G.R. No. 561 of 2016) for offences under Sections 323, 354, 379, 504, 506 and 34 IPC.

Learned counsel for the petitioner submits that on account of land dispute there is case and counter case. The petitioner no. 2 has no criminal antecedent.

Considering the fact that petitioner no. 2 has no criminal antecedent, the Court is inclined to grant bail to the petitioner No.2. Let the petitioner No. 2, above named, in the

No.5191 of 2020(2) dt.19-06-2020 2/2 event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Benipatti (Madhubani) in connection with Bisphi P.S. Case No. 140 of 2016 (G.R. No. 561 of 2016), subject to the conditions as laid down under Section 438(2) Cr. P. C.

So far as the petitioner No. 1 is concerned, considering his criminal antecedent, the court is not inclined to grant him anticipatory bail. The prayer is rejected. The petitioner No. 1 shall surrender and pray for regular bail before the court below which shall be considered and disposed of by the court below on the same day without being influenced by the rejection of his anticipatory bail application.
