====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date : 04-10-2018 Heard learned counsel for the petitioner and counsel for the Bank.

In the present case, the claim has been made that the petitioner should be allowed to join in the Bank. The petitioner has gone for maternity leave in the year 2013 but, till date, she has not joined the post and the leave expired on 21.10.2013 and, thereafter, she has not joined till date although, earlier, she was interested to join at Patna but, now she wants to join at Ranchi.

Patna High Court CWJC No.15012 of 2018 dt.04-10-2018 2/2 The absence without leave by an employee is a very serious matter but, fairly stated by the Bank that no action has been taken against the petitioner though a show-cause was issued but, it has not reached to its finality. Now she has come before this Court making a prayer that the Bank should allow her to join at the place of posting.

Let this writ application be treated as a representation before the authority concerned and will take a decision keeping in view that the person, who has remained absent, cannot be treated to have been disentitled to join the place of posting assigned by the Bank but, the Bank, after joining at new place of posting, may take legal action in accordance with law.

With the aforementioned observation and direction, this writ application is disposed of.
