Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Itarhi P.S. Case No. 139 of 2022 registered for the offence under Sections 363, 366A of the Indian Penal Code and Section 4 of the POCSO Act.
The prosecution story in short is that the petitioner abducted the daughter of the informant with an intention to marry her.
Learned counsel for the petitioner submits that the petitioner is in custody since 19.05.2022 and the petitioner has no criminal antecedent and he is quite innocent.
Patna High Court CR. MISC. No.2383 of 2023(3) dt.25-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.
The victim girl in her statement made under Section 164 of the Cr.P.C., has not alleged anything against the petitioner.
Considering the statement of the victim girl and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-VII-cum-Special Court, POCSO Act/concerned Court below in connection with Itarhi P.S. Case No. 139 of 2022.
