JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2015 Petitioner is languishing in custody since 18.12.2014 in a case registered for the offences punishable under Sections 376, 511 of the Indian Penal Code. It is alleged that petitioner attempted to establish forceful physical relationship with the informant. It is submitted by learned counsel for the petitioner that for the occurrence of 11.11.2014 the First Information Report was registered on 27.11.2014. The informant is in habit of lodging such false cases as she lodged a case against Kishun Mandal @ Krishan Chandra Mandal making accusation under Sections 323, 376, 379, 493, 504/34 of the Indian Penal Code but subsequently compromised the matter. Moreover there is no medical report on record and the investigation has already concluded.

Patna High Court Cr.Misc. No.14042 of 2015 (2) dt.27-04-2015 2/2 petition that petitioner has no criminal antecedent. Considering the delayed lodging of the complaint and the investigation already concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jhanjharpur, Madhubani in connection with Phulparas P.S. Case No. 311 of 2014.
