The petitioner is languishing in custody for the offences punishable under Section 414 of the Indian Penal Code and Sections 30(a)/37(d)/38/41 of the Bihar Prohibition and Excise Act, 2016.
Liquor was recovered from an orchard and it is alleged that the petitioner was apprehended while fleeing from the place of recovery. The petitioner stated to the police that he had gone there to purchase the same from Anand Sahani and Bhikhari Sahani. The petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 22.11.2019. Considering the entire facts as well as completion of investigation, let the petitioner, above named, be released on
Patna High Court CR. MISC. No.853 of 2020(2) dt.16-01-2020 2/2 bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Patahi P.S. Case No.346 of 2019, with following conditions: s (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the Court.
