JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-04-2023 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Raxaul P.S. Case No. 334 of 2022 registered for the offences punishable under Sections 341, 323, 307, 379, 504, 506 of the Indian Penal Code .

As per the prosecution case, the accused persons indiscriminately assaulted the informant with iron rod in the market causing severe injury and also snatched cash of Rs. 40,000/-.

It is submitted by the learned counsel for the petitioners that petitioners are innocent and have falsely been

It is also submitted that petitioner no. 1 and 2 are Bhagina of informant and the allegation has been made only to harass the petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Sub Divisional Judicial Magistrate, Motihari, East Champaran in Raxaul P.S. Case No. 334 of 2022 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J) N.K/- U T
